Taxe d'Habitation being Charged on Gite

We have a gite at the bottom of our garden. The property is only used as a gite and we declare our income to the taxman each year.
We live in our main house at the other end of the garden and have no reason therefore to use our gite as a maison secondaire.
Nevertheless, last December we received a demand for taxe d'habitation on our gite. We paid it, and hoped to contest it.
French friends of ours who have a gite say we should.
Our tax adviser says no point, all separate properties are now classified as a maison secondaire and it is only gites attached to the main property that can avoid this.
Has anyone in the same situation as us had any success at having the taxe d'h waivered?

Ooh it's no fun getting an unexpected tax demand. It's certainly worth asking for a refund, theoretically there's nothing to lose!

But... I found this official documentation which concurs (mostly) with what your tax advisor says, even though the space you rent is not a résidence secondaire : https://bofip.impots.gouv.fr/bofip/546- ... 0-20201222
It says, "Les pièces faisant partie intégrante de l'habitation du loueur et louées en meublé de manière saisonnière sont soumises à la taxe d'habitation." - in other words, any parts of your main residence that are occasionally rented out furnished are subject to taxe d'habitation.
Then it goes on to say, you could be exempted from the CFE, another tax... which they don't seem to have come for.

If you weren't asked to pay the taxe d'habitation before, I wonder if this is another case of the local town/village going after every bit of tax income they think they're entitled to now that a lot of central funding has been cut and most people don't pay taxe d'habitation any more on their main residence. Good luck anyway.

Hi Anno, thanks for the support. We've sorted out the paperwork we need and have sent our correspondence to someone at the central tax office in Agen who liaises with our mayor - so we'll see.
Interestingly, I'm getting advice elsewhere that it might be cheaper for us to get a siret number and pay cfe instead.
Certainly we agree the local office is pushing for every centime they can!
