exceso de cabida en el registro

Post by costa-brava »

If you're really good at Spanish or of you try the google translator you'll come up with excess of space or of capacity in the register.
In fact it's a new quirky bit of Spanish legislation that you should be aware of in you are a property owner and ESPECIALLY if you're contemplating selling.
Like I said in the last post, there are lots of bits of law that factor in if you have property in Spain.
It stems from a new law on mortgages that made it compulsory for the banks, property register, cadastro and notario to integrate electronically before the date of a property purchase. What this "cabado" thing really means is that there is a discrepancy between your property details in the Property Register and the new valuation by the surveyor of the bank. Or it may appear at the notario when they check against the details held by the office of Cadastro.
If you think it doesn't matter to you because you're not involved with any mortgage that doesn't matter. There was a subsequent part of the law that refers to Cadastro.
Probably more than half of properties bought before around 2015 will have a discrepancy because the notario just took the details from the old escritura.
It is fairly easily corrected but you could find that a savvy buyer presents it as a huge problem in order to push down the price.
